If the availability of the Covered Service falls below 99.9% during the Term (each, an “Availability Event”), Customer may claim a fee credit for the next Renewal Period of the Covered Service (“Fee Credit”) by notifying Smartsheet via the web form at help.smartsheet.com/contact/smartsheetapp. This notice must include all the information required in this form and must be sent within 30 days of the end of the calendar month in which the availability event occurred in order for the customer to be entitled to a fee credit. The MOBILE EULA governs your use of the Smartsheet mobile app for Android and iOS. ANY PERSON WHO AGREES TO BE BOUND BY THIS AGREEMENT ON BEHALF OF AN ORGANIZATION OR OTHER LEGAL ENTITY REPRESENTS THAT SUCH PERSON HAS THE AUTHORITY TO BIND SUCH LEGAL ENTITY TO THE TERMS CONTAINED HEREIN. HE DOES NOT FAIL BECAUSE OF HIS DEMANDS. ESSENTIAL OBJECTIVE. CUSTOMER MAY NOT ACCESS OR USE THE SERVICES WITHOUT SMARTSHEET`S PRIOR WRITTEN CONSENT IF CUSTOMER IS OR BECOMES A DIRECT COMPETITOR OF SMARTSHEET OR ITS AFFILIATES. Fee credits are Customer`s sole remedy and Smartsheet`s sole liability under this SLA for any availability issues customer may encounter with respect to the Covered Service. If, regardless of this SLA, Customer requests or receives relief or recourse from Smartsheet regarding an availability issue, Customer is not entitled to claim or receive fee credits under this SLA with respect to that availability issue. .
